TERMS AND CONDITIONS

1.1 All customers must be over age 16 and legally entitled to purchase spectacles from TheGlassesShop.net.
1.2 Customers must not be registered partially sighted or blind.
1.3 Customers must be in possession of a valid prescription and must on request provide us with a copy of this prescription.
1.4 All prescriptions must have been provided to you by a registered medical practitioner or registered optometrist/ ophthalmic optician.
1.5 Customers must have had an eye examination carried out within a 2 year period or less as advised by their practitioner.
1.6 All details that you, the customer, provide to us including address, contact details and payment information must be up to date and correct.
1.7 TheGlassesShop.Net will rely fully on the prescription provided to us by you, the customer.
1.8 Unless specified by you the customer, we will use an average PD (Pupillary Distance) of 60mm to complete your order. You, the customer, agree for us to use an average PD unless you state otherwise. TheGlassesShop.Net however recommend that you consult your optician to obtain your PD before placing your order.

2.1 All goods advertised for sale on our website are subject to availability. If for any reason an item is unavailable, you the customer will be informed as soon as possible by email or telephone. A replacement item or refund will be offered to you.
2.2 Items that cannot be supplied will not be charged for, however, we will not be held responsible for any loss to the customer for goods that have not been supplied.
2.3 All items for sale are described as accurately as possible. Photographs are for illustrative purpose only and may not match exactly the product itself.
2.4 Prices displayed are correct at time of display. We reserve the right to alter prices without notice. This does not affect customers who have made payment prior to price change.
2.5 The price of postage and packaging is subject to change. Prices for postage and packaging are per pair of glasses ordered.

3.1 Payment must be made by the customer at the time of ordering.
3.2 We accept various credit and debit cards as listed on our website.
3.3 Credit card payments are subject to authorisation by the card issuer. We cannot be held responsible for non-delivery of goods due to a declined payment authorisation.
3.4 Payment by credit card is entirely at the customers own risk. We cannot accept responsibility for any misuse of a customers credit card.
3.5 The customers delivery address must be the same as that specified to the customers credit card provider.
3.6 Payment by cheque is acceptable but goods will not be despatched until the cheque and payment has been received.
3.7 All payments are in Great Britain Pounds (£) only.

4.0 Goods will only be despatched after payment is received and only to the address specified by the customer on the order form.
4.1 All goods are despatched as soon as possible. We cannot be held responsible for late delivery before the 30 day delivery period caused by the manufacturers or a third party.
4.2 If the customer does not accept delivery of goods then an additional fee may be charged to cover any reasonable costs including storage, insurance and delivery.
4.3 Any damage to goods incurred after delivery is the sole responsibility of the customer.
4.4 The customer is required to inspect the goods on delivery. Do not use the goods if damaged and please contact us immediately by email, phone or fax if the goods are missing or damaged.
4.5 TheGlassesShop.Net will not pay for the cost of return of goods to us.
4.6 The customer should use a method of returning goods to us whereby proof that the goods have been sent and received by us may be obtained. We will not issue refunds for goods that do not arrive at the returns address.

5.0 The customer has 14 days to return goods that they are dissatisfied with. This does not affect your statutory rights.
5.1 Any items damaged whilst in the customers possession will not be accepted for refund or replacement. All responsibility for goods passes to the customer on acceptance of delivery.

6.1 We do not accept responsibility for damage to goods caused by the customer once the goods are received by the customer.
6.2 We are not liable to any person for damage or loss arising from the use of any goods purchased from us.
6.3 Under no circumstances will we be liable to you the customer for any business interruption, loss of use, loss of data, loss of profits, contracts, goodwill or anticipated savings.
6.4 Our maximum liability and that of our employers, agents and sub-contractors to you in connection with any physical damage to your property through negligence will not in any circumstances exceed the sum of £10,000 (Ten thousand pounds sterling).
6.5 Any information and material contained on our website are provided on an “as is” basis with no warranty. We do not represent or warrant that the information accessed via this site is accurate, complete or current or that the use of this site will be uninterrupted or error free.
6.6 In all other cases, our total liability (including our employees, agents and sub-contractors) whether in contract, tort (including negligence) and breach of statutory duty or otherwise will not exceed the price of the goods and services to which the claim relates,

7.1 Terms and conditions are subject to change without prior notice to the customer.
7.2 We reserve the right to refuse to sell any item to any customer as we deem fit.
7.3 TheGlassesShop.Net website does not provide medical diagnosis to any person. The website and any information contained in it should not be used instead of professional medical advice. Any medical questions must be directed to a registered medical practitioner or ophthalmic optician/ optometrist.
7.4 Goods sold to the customer must not be re-sold.

8.0 We may record telephone calls made to us.

9.0 When you visit the website of TheGlassesShop.Net your computer will receive a cookie. Cookies are pieces of information transferred to your computers hard drive for record keeping purposes. We cannot identify you personally in any way.
9.1 We are committed to protecting the customers privacy and to provide the customer with a secure online buying process.
9.2 TheGlassesShop.Net, its employees, agents and sub-contractors shall at all times comply with the Data Protection Act 1998. We shall only process personal data received from you where necessary to fulfil our obligations under contract to you.
